MEETING CALLED TO ORDER AT 6:32 P.M. BY CHAIRPERSON JOE ABELL ROLL CALL- Chairperson Joe Abell-present, Supervisor Larry Austin-present, Supervisor Bill Pearce- present, Treasurer Marisa Nor-not present for roll call but was present for remainder of the meeting, Clerk Deanna Swonger-present, Road Superintendent Mike August-present. AMEND AGENDA: A) Bella Grays Inn submitted 7 bartender license applications and paid $140.00 to former clerk Angella Bucholz. There is no file on Bella Grays and no applications on file at Town Hall. Todd Ryan is going to be faxing employee information to Town Clerk and we will be issuing bartenders licenses to Todd from Bella Grays Inn pending background checks to be valid until June as all licenses need to be renewed. AUSTIN/PEARCE 2nd made a MOTION to approve bartenders licensing tentatively pending results of background checks. MOTION carried 3-0 without negative vote. APPROVE MINUTES: AUSTIN/PEARCE 2nd made a MOTION to approve minutes from January 12th, 2010 Town Board Meeting. MOTION approved with 3-0 vote. Motion carried unanimously without negative vote. PLAN COMMISSION REPORT: No report. PUBLIC COMMENTS: John O’Neill requesting his file be reopened as he missed last months meeting and many previous meetings. His request to rezone property A-1 to A-4 was denied by the Town of Walworth Town Board 01/12/2010. He is requesting being added to the agenda for March regarding his rezone request. Bob Dodge requesting that we do not put John O’Neill back on the agenda. He states that John O’Neill is still violating even after he was denied at last months meeting by bringing additional wood onto his property. The Town of Walworth Town Board cannot make a decision as we have already denied this. Requested that John talk with Matt Weidensee from the Land Use and Resource Management department. Such a conversation will help to ensure that Mr. O’Neill is aware of proper procedure so as to avoid committing the same errors which caused his application to be denied the first time if and when he chooses to begin the application process all over again. His request will not be put on the agenda until proper amount of time has elapsed. REFERRAL TO PLAN COMMISSION: A) Aim to establish farming zone B) Glenn Feltham rezone parcel for new building for tax parcel EW 600007. C) Comprehensive Walworth County Zoning Ordinance Amendment WALWORTH BOARDER AGREEEMENT: NONE NEW TOWN HALL FACILITY: 262 total votes cast. 79 no votes and 182 yes votes. OLD BUSINESS: None NEW BUSINESS: Resolution 021810-1 to give authority to the Treasurer to pay bills prior to board approval that may cause the town to receive a cash discount or late fee. AUTIN/PEARCE 2nd made a MOTION to approve the resolution. MOTION carried unanimously 3-0 without negative vote. Resolution 02.18.2010 for public to request to be added to regular Town Hall meeting agenda or taken off regular Town Hall meeting agenda. Amended the resolution to say petitioner instead of resident. Once that correction was made PEARCE/AUSTIN 2nd made a MOTION to approve the resolution. MOTION carried 3-0 without negative vote. FIRE INSPECTOR: Board has decided to cancel the contract that begun 04/20/1998 with Fire Inspection Services Inc. that will end 05/01/2010. AUSTIN/PEARCE 2nd made a MOTION to approve the cancelation and to seek services from the Village of Walworth paid on premises department. Clerk will write a letter to current company requesting cancellation. Department of Revenue County Assessment proposal: PEARCE/AUSTIN 2nd made a MOTION to approve the resolution 02.18.2010-3 to oppose DOR County Assessment Proposal. MOTION carried 3-0 without negative vote. Comprehensive Walworth County Zoning Ordinance Amendment: Refer to Plan Commission. Jodi Mordini requested that her $125.00 garbage/recycling fee be removed form tax parcel EH00037. ABELL/ AUSTIN made a MOTION to deny request for garbage/recycling fee to be taken off considering there is livable property standing. Clerk will write a letter to Jodi Mordini explaining denial. Duane Leseberg requesting garbage/recycling fee taken off bill for 2009 and 2010. AUSTIN/PEARCE 2nd made a MOTION to approve the refund of $120.00 for 2009 for the garbage/recycling he has been overcharged. MOTION carried 3-0 without negative vote. Distribution of Final Comprehensive Plan: Books are available to public for $25 each. ETZ REPORTS: NONE BOARD REPORTS TREASURER REPORT: AUSTIN/PEARCE 2ND made a MOTION to approve Treasurer Report and MOTION carried unanimously 3-0 without negative vote. CLERK REPORT: Reported on election results. 77 total votes with 12 being absentee in-person ballots cast at Inspiration Ministries, and 65 in-person ballots cast at Town of Walworth Town Hall. SAFETY UPDATE: Larry reported on the fire and rescue calls for the month of January 2010. ROAD AND BUILDING CONDITIONS: Mike gave report that roads are getting full of potholes, and repairs are going to begin shortly. One of the trucks broke down, but is up working again. JOE ABELL, LARRY AUSTIN AND BILL PEARCE-CITIZEN’S CONCERNS: None FUTURE AGENDA ITEMS: A) Glen Feltham rezone request for tax parcel EW 600007. Next monthly meeting will be Tuesday March 9th, 2010 at 6:30 p.m. REVIEW BILLS FOR PAYMENT: PEARCE/AUSTIN 2nd made a MOTION to approve the bills and the MOTION carried unanimously 3-0 without negative vote. ADJOURNMENT: PEARCE/AUSTIN 2ND made a MOTION to adjourn meeting at 9:00 p.m. and the MOTION carried unanimously 3-0 without negative vote.
