DRAFT OF MINUTES FOR REGULAR MEETING HELD ON TUESDAY MARCH 9th, 2010 AT TOWN HALL, N1301 TOWN HALL ROAD, WALWORTH, WI 53184

MEETING CALLED TO ORDER AT 6:30 P.M. BY SUPERVISOR 1 LARRY AUSTIN. AT 6:34 P.M SUPERVISOR 1 LARRY AUSTIN CONVENED THE PUBLIC HEARING AND AT 6:36 P.M THE REGULAR TOWN HALL MEETING RECONVENED.

ROLL CALL- Chairperson Joe Abell- not present, Supervisor Larry Austin-present, Supervisor Bill Pearce- present, Treasurer Marisa Nor- present, Clerk Deanna Swonger-not present, Road Superintendent Mike August-present, Deputy Clerk Justin Swonger- present.

AMEND AGENDA: NONE APPROVE MINUTES: PEARCE/AUSTIN 2nd made a MOTION to approve minutes pending clarification in public comments regarding John O’Neill’s course of action to have his rezone request considered as he must speak with Matt Weidensee from Land Use and Resource Management and follow the normal protocol when a denial has taken place from the February 18th, 2010 Town Board Meeting minutes. MOTION approved with 2-0 vote. Motion carried unanimously without negative vote. PLAN COMMISSION REPORT: Plan Commission met 03/01/2010. Glen and Becky Feltham requested rezone and conditional use for tax parcel 600007 for 5.39 acres to be rezoned from A-2 to A-4. Motion carried and passed.

Walworth Border Agreement was discussed. Plan Commission is looking to preserve the farmland to the south. Plan Commission is trying to get information regarding farming zones

REFERRAL TO PLAN COMMISSION: NONE

WALWORTH BOARDER AGREEEMENT: NONE

NEW TOWN HALL FACILITY DISCUSSION: We need to have a publication showing that the Annual Meeting will be held at the Walworth Elementary School.

OLD BUSINESS: None

NEW BUSINESS: Glen and Becky Feltham rezone and conditional use request fro tax parcel EW 600007. PEARCE/AUSTIN 2nd made a MOTION to approve. MOTION carried unanimously 2-0 without negative vote.

ETZ REPORTS: NONE

BOARD REPORTS

TREASURER REPORT: AUSTIN/PEARCE 2ND made a MOTION to approve Treasurer Report and MOTION carried unanimously 2-0 without negative vote.

CLERK REPORT:

1) Denial letter was sent to Jodi Mordini in regards to the request made to have the garbage/recycling fee taken off her tax bill. 2) I was able to generate new bartending licenses for the employees of Bella Grays Inn. I am awaiting the return of the applications so I may complete a criminal background check on those employees. 3) Sent a letter to Fire Inspection requesting the termination of our contract with them effective April 30th, 2010. 4) Received a letter from Land Use and Resource Management stating that the rezone request made by John O’Neill (JMO Properties) was denied by the County Zoning Agency on February 18th, 2010 and the matter will go to the Walworth County Board of Supervisors March 9th, 2010. L.U.R.M also notified Mr. O’Neill that he is in violation of Section(s) 74-37 and 74-51 of the Walworth County Code of Ordinances for tax parcel # EA271100001 and he has 30 days to bring the property into compliance. If he does not do so he will be in violation of the Zoning ordinances and be fined $663.00 for each offense and each day a violation exists.

SAFETY UPDATE: Larry reported on the fire and rescue calls for the month of February 2010. ROAD AND BUILDING CONDITIONS: Mike gave report that roads are getting full of potholes, and repairs are going to begin shortly. One of the trucks broke down, but is up working again.

FUTURE AGENDA ITEMS: Annual Meeting

Next monthly meeting will be Tuesday April 13th, 2010.

REVIEW BILLS FOR PAYMENT: PEARCE/AUSTIN 2nd made a MOTION to approve the bills and the MOTION carried unanimously 2-0 without negative vote.

ADJOURNMENT: PEARCE/AUSTIN 2ND made a MOTION to adjourn meeting at 7:25 p.m. and the MOTION carried unanimously 2-0 without negative vote.
