RESOLUTION NO. 01.06.05 OF THE TOWN OF WALWORTH

Board Policy for Conditional Use Permits, Re-zones, and Certified Surveys

WHEREAS, elected officials of the Town of Walworth must have ample time to review applications of Conditional Use Permits, Re-zones, and Certified Surveys; and

WHEREAS, it has been the policy of the Board for the Town of Walworth to make every possible effort to keep neighbors of the applied property informed of property changes that may affect them; and

WHEREAS, ample time is needed for area residents to voice concerns, praise and ask questions to the Board and land owner.

NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Walworth hereby adopts procedures that must be followed by applicants of Re-zones, Certified Surveys, and Conditional Use Permits.

The Clerk of the Town of Walworth is hereby directed to carry out the provisions of this Resolution.

Procedures for Town of Walworth Re-zone, Certified Survey, and Conditional Use Applicants

For all matters regarding zoning, conditional use, and certified surveys the following are the requirements for both the applicants and the Town Board:

1. The applicant must submit its application (the applications he/she/it has filed with Walworth County) or a narrative of what the applicant is intending to accomplish to the Town Clerk at least thirty (30) days prior to the Town Board meeting.

2. The applicant must submit a $100.00 fee to the Town Clerk for re-zone and certified survey. The processing of the application together with 5 copies of the application/narrative, survey, if required, and any other documentation deemed necessary by the applicant.

3. Between the date of filing the application and the board meeting, all members of the Town of Walworth Board must personally view the property.

4. In the matter of rezones and conditional use applications, the Town Clerk shall provide a standard sign(s) to be posted on the property in a prominent location visible from all public roadways that adjoin the property at least 10 days before the Town Board meeting where the application will be discussed. The applicant will need to put a deposit of $5.00 down per sign. The deposit will be refunded upon the sign(s) return.

5. At the Town Board meeting, all those in favor and against the applicant’s request shall have an opportunity to speak. The Chairperson, in his/her discretion, may limit the time a person can speak if he/she deems there is a special circumstance for such limitation.

6. Once all persons have had an opportunity to speak, the Board will then deliberate on the matter.

7. After the Town Board has had sufficient time to deliberate and ask questions of all parties involved. The Board shall reach a decision of yea, nay, or to table the request. The Town Clerk will notify Walworth County of the Board’s decision.
